We are going to study how the law affects managers and management, in general. This is important for you to know as employees as well as potential future employers. Important note: One may not follow the law, but one should be aware of the ramifications of the management employment decisions one makes. For instance, as an employee, you may know that your employer has no right to do something, but you submit to it anyway because you don’t want to lose your job or have to go to court. As an employer, you may know that your actions are not legal according to the letter of the law, but you weigh the costs and benefits and decide to do it anyway. Simply, you must know the law in order to weigh the costs!

There is now a knowledge gap among professionals since most managers and personnel practitioners have not had formal training in the application of new employment laws to the workplace. In addition, most lawyers may understand the law as it is applied to a business relationship, but not to employment relationships.

Let’s start. Please visit the following three websites. Explore them thoroughly. Then come back to our discussion thread and tell us what you find. Maybe you will find some material that relates to this week’s textbook chapters. Refer to the text or use Online to find at least three examples of how poor risk management impacted a health organization. 

Topic: Managing Risk in the Healthcare Industry and Regulatory Bodies and Laws

• Topic 1: What types of risk must be managed in the healthcare setting? For example, what specific types of risks are commonly associated with healthcare settings?
• Topic 2: Chapter 10 in the required text discusses laws related to aspects of patient care. What are these laws? Are there related laws other than these in your state’s statutes and regulations? If so, what are they?

Discuss ethical considerations for residents of long-term care facilities. Read Chapter 13 and discuss many of the ethical considerations for those considering or living in long-term care facilities. For example, discuss:

• access
• rationing
• the transfer of assets
• autonomy

      as well as some of the other ethical issues discussed.

1. Informal Caregiving: Contrast the positive and negative aspects of caregiving from the caregiver’s perspective and discuss the issues that tip the balance for any given individual. Page 33 in the text discusses the problem of inadequate support for informal caregivers. Along with the video on this page, the video, “A Window into The Daily Struggles of Long-Term Care” on the Week 1 Page is useful to watch for this discussion. How would support and incentives for informal caregivers support our current long-term care system?

• Continuum of Care: Long-term care providers may be considered in a continuum of care. Summarize this concept and include the three elements of a continuum discussed in (Chapter 1: Long-Term Care Today: Turbulent Times)
